Terms and Agreement

This contract (the "Agreement") is entered into between Andrea McCloud of McClouds Poodles & Doodles (hereinafter referred to as the "Seller," "We," or "Our") and

(hereinafter referred to as the "Buyer," "You” or "Your") on

(the "Effective Date")

PAYMENT - I agree to the terms of Payment Below

The Buyer agrees to pay the deposit and total billable amount stated on the first page of the Agreement by or before the stated dates. The non-refundable deposit must be paid to reserve the desired puppy. The remaining amount shall be paid to the Seller upon the puppy's delivery or pick-up. The Buyer is responsible for any additional fees, such as fees for transportation, required health certifications, and any other special requests. Although deposits are nonrefundable, they are transferrable for a total time length of two years from the date of the deposit placement.

HEALTH GUARANTEE - I agree to the terms of HEALTH GUARANTEE Below

The Seller guarantees that, to the best of their knowledge, the puppy is in good health at the time of sale. A licensed veterinarian has examined the puppy and found it to be free from any known diseases or illnesses. The puppy has also undergone all the necessary vaccinations, deworming, and other required health preventative measures. The Seller agrees to provide a health record with vaccinations and deworming information to the Buyer. The health guarantee is valid for five days from the date of purchase. During this period, the Buyer is strongly encouraged to have the puppy undergo a general health examination by a licensed veterinarian at the Buyer’s expense. If the licensed veterinarian determines that the puppy is suffering from a serious health issue, the Buyer should notify the Seller immediately and provide written records of the veterinarian's findings. In the event of a serious health issue, the Seller reserves the right to seek a second opinion from a veterinarian of their choice to confirm the puppy’s condition and diagnosis. The Buyer agrees to cooperate with this process. If both parties agree that the puppy is determined to be unfit for sale, the Buyer may return the puppy for a full refund or exchange it for another puppy of similar value, if available. Any difference in pricing will be paid for by the Buyer or returned by the Seller, as applicable. No refunds or exchanges will be issued after this time period. Costs of any medical treatment after the health guarantee for any reason will be the responsibility of the Buyer. This health guarantee does not cover minor health issues or conditions. grade I or II heart murmur, cherry eye, entropion, ectropion, allergies, undescended testicles, pyomentra, overbite, underbite, loose knees or hips, umbilical hernia, color dilution alopecia, or dermatitis of any kind included but not limited to demodectic mange. Seller will not replace puppy/dog due to heat stroke, abuse/neglect, or improper socialization/temperament. This puppy is guaranteed against congenital life threatening defects until one year of age. Should the puppy die within that time as a direct result of a congenital defect, the puppy will be replaced ONLY if a licensed vet performs an appropriate necropsy, and a vet’s certificate is provided as proof of cause of death. McClouds Poodles & Doodles will replace said puppy/dog with one of equal quality when there is one available. Cost of this report and examination is the responsibility of the buyer. The seller assumes no responsibility of this puppy after leaving the premises of the seller for medical expenses due to injury, landlord’s or spouse disapproval, allergy to animals, disagreement of family, conflict of personality, flight nanny/ground transporter injury/neglect or for any other reason unless outlined in this agreement. Therefore it is agreed that no warranty or representation has been made with respect to sold puppy except as set forth in writing in this agreement. Our dogs and puppies have not been exposed to infectious diseases here. If your puppy is exposed to an infectious disease after it leaves here, this is not covered under this health guarantee. That is, infectious diseases are not covered by our health guarantee, as we have no control over what said puppy is exposed to after it leaves our home. We also cannot guarantee that your puppy will never develop any future health problems. Our sires and dams are free of known genetic defects, diseases and disorders or we would not breed them. We have also provided the buyer with copies of related genetic testing. This means that puppies are less likely to develop problem in the future. However, we cannot guarantee that puppies will never develop any future problems.

SOCIAL MEDIA POLICY - I agree to the terms of SOCIAL MEDIA POLICY Below

Buyer shall not use Facebook or any other social media platform for postings as a way to notify breeder, or provide public announcement of issues with their puppy or to mitigate disagreements. Photos or video of any injury, illness or post-surgical care shall not be posted on Facebook or other social media outlets. Communication of health-related items and or disagreements shall be done privately, via phone, email or private messages only. Social media is not appropriate for these types of issues.

SPAYING/NEUTERING POLICY - I agree to the terms of SPAYING/NEUTERING below

The Buyer agrees to spay/neuter the puppy no later than 12 months of age. The Buyer shall be responsible for scheduling and covering all costs associated with the spaying/neutering procedure. Buyer guarantees that this puppy will not be bred or used for stud services or breeding of any kind at anytime. If the said puppy is not spayed or neutered on or before 12months of age, the puppy must be surrendered back to the seller unconditionally as the buyer will be in breech of contract. If puppy is bred, either intentionally or accidentally, Buyer is in breech of contract and agrees to pay the Seller a fee of $2500 plus an additional fee of $2000 per puppy produced from the mating regardless as to if the mating is intentional or accidental. This fee is also in addition to surrendering the puppy/dog back to the seller unconditionally as the buyer will be in breech of contract.

VETERINARY CARE POLICY - I agree to the terms of VETERINARY CARE below

The Buyer agrees to ensure that the puppy receives all the necessary vaccinations, including booster shots, as per the recommendations of a licensed veterinarian. The Buyer also agrees to follow the recommended deworming schedule provided by their veterinarian. The Buyer is responsible for all costs associated with vaccinations, deworming, and any other vet consultations or treatment.

PUPPY REGISTRATION POLICY - I agree to the terms of PUPPY REGISTRATION below

The Seller shall provide the Buyer with the required registration papers for the puppy, if applicable. These registration papers will provide information about the puppy’s pedigree and lineage, which may allow for individual registration with the relevant kennel club or breed registry.

RESPONSIBLE OWNERSHIP - I agree to the terms of RESPONSIBLE OWNERSHIP below

The Buyer commits to ensuring the puppy receives proper care. This includes but is not limited to a safe and clean living environment, fresh water, food that meets the puppy’s nutritional requirements for its breed and age, and shelter from extreme weather conditions. The buyer also agrees to provide regular exercise, mental stimulation, adequate grooming, and routine vet checkups for the puppy.

RETURN POLICY - I agree to the terms of RETURN POLICY below

If the Buyer can no longer care adequately for the puppy, the Buyer agrees to notify the Seller. The Seller will be given the “first right of refusal.” This means that the Seller will be given the opportunity to take back the puppy to locate a new home for it. If both parties agree that the puppy should be returned to the Seller, the Buyer acknowledges that they may not be entitled to a refund, and any costs associated with returning the puppy to the Seller are the Buyer’s responsibility. The Buyer should return the puppy with any provided documentation and records, including registration papers and health records. If the Seller is not in a position or unwilling to accept the puppy, the Buyer commits to making diligent attempts to locate an appropriate new home for the puppy. The Buyer also agrees not to transfer the puppy to a shelter, rescue organization, research facility, or pet store without the Seller's prior written approval.

TRANSFER OF OWNERSHIP - I agree to the terms of TRANSFER OF OWNERSHIP below

If the Buyer can no longer care adequately for the puppy, the Buyer agrees to notify the Seller. The Seller will be given the “first right of refusal.” This means that the Seller will be given the opportunity to take back the puppy to locate a new home for it. If both parties agree that the puppy should be returned to the Seller, the Buyer acknowledges that they may not be entitled to a refund, and any costs associated with returning the puppy to the Seller are the Buyer’s responsibility. The Buyer should return the puppy with any provided documentation and records, including registration papers and health records. If the Seller is not in a position or unwilling to accept the puppy, the Buyer commits to making diligent attempts to locate an appropriate new home for the puppy. The Buyer also agrees not to transfer the puppy to a shelter, rescue organization, research facility, or pet store without the Seller's prior written approval.

BREEDING/SHOW RIGHTS (IF APPLICABLE) - I agree to the terms of BREEDING/SHOW RIGHTS (IF APPLICABLE) below

The Seller will be given the “first right of refusal.” This means that the Seller will be given the opportunity to take back the puppy to locate a new home for it. If both parties agree that the puppy should be returned to the Seller, the Buyer acknowledges that they may not be entitled to a refund, and any costs associated with returning the puppy to the Seller are the Buyer’s responsibility. The Buyer should return the puppy with any provided documentation and records, including registration papers and health records. If the Seller is not in a position or unwilling to accept the puppy, the Buyer commits to making diligent attempts to locate an appropriate new home for the puppy. The Buyer also agrees not to transfer the puppy to a shelter, rescue organization, research facility, or pet store without the Seller's prior written approval.

ENTIRE AGREEMENT - I agree to the terms of ENTIRE AGREEMENT below

This contract constitutes the entire agreement between the Buyer and the Seller regarding the purchase and sale of the puppy and supersedes all prior discussions, understandings, representations, and agreements, both written and verbal. This contract agreement is binding to buyer and seller and is non transferable. By signing this contract I agree with the terms and conditions of the contract. Any legal action taken will be paid by the Buyer and will take place in Cabell County, West Virginia.

FORCE MAJEURE - I agree to the terms of FORCE MAJEURE below

Neither party shall be held accountable for unforeseeable circumstances or events beyond their control, including acts of nature, government actions, war, epidemics, or other events hindering the contract’s performance. The affected party must promptly notify the other party and make reasonable efforts to mitigate the event's effects.

SEVERABILITY - I agree to the terms of SEVERABILITY below

If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law, the invalidity, illegality, or unenforceability of such provision shall not affect the validity or enforceability of the remaining provisions of this Agreement.

No modification, amendment, or alteration of this Agreement shall be binding unless it is made in writing and duly executed by both parties. By signing below, both parties acknowledge and agree to the terms and conditions stated in this Agreement.
